These SMS Terms of Service (“SMS Terms”) govern text messages sent by Mountain Top Propane, Inc. (“Mountain Top Propane,” “Company,” “we,” “us,” or “our”).
By consenting to receive SMS messages from Mountain Top Propane, you agree to these SMS Terms. Your use of Mountain Top Propane’s propane services remains subject to any applicable customer service agreement and other terms governing your account.

If you separately consent to receive marketing messages, Mountain Top Propane may send promotional or marketing texts regarding products, services, programs, pricing offers, seasonal promotions, or other sales-related information.
Consent to receive marketing or promotional text messages is not required as a condition of purchasing propane, equipment, or services from Mountain Top Propane.
Mountain Top Propane sends informational or promotional text messages only as permitted by applicable law and applicable messaging-provider requirements.
Consent may be provided through a written or electronically signed authorization, an online form, or another consent method permitted for the applicable type of message.
Service and account messaging consent and marketing consent may be requested and maintained separately.
If you initiate a text-message conversation with Mountain Top Propane, we may respond to your request or continue the conversation as reasonably necessary to address your inquiry.
Message frequency varies.
The number of messages you receive will depend on factors including your account activity, deliveries, service requests, appointments, communications with Mountain Top Propane, and the categories of messages you have elected to receive.
Mountain Top Propane does not guarantee a particular message frequency.
Message and data rates may apply depending on your wireless carrier and service plan.
Mountain Top Propane is not responsible for charges imposed by your wireless carrier.
You may opt out of text messages at any time by replying STOP to a text message from Mountain Top Propane.

Other clear requests to stop receiving text messages will be honored as required by applicable law and messaging-provider requirements.
After you opt out, you may receive one additional message confirming that your opt-out request has been processed.
Depending on the technical capabilities of the messaging platform or sending number, replying STOP may stop all SMS messages from that number rather than only a particular category of messages.
Opting out of SMS does not prevent Mountain Top Propane from communicating with you by mail, email, live telephone call, or another method permitted by your customer agreement or applicable law.
You may opt back in to eligible text messaging by providing new consent or, where supported, by replying START.

DO NOT USE TEXT MESSAGING TO REPORT A PROPANE LEAK, FIRE, GAS ODOR, OR OTHER IMMEDIATE SAFETY EMERGENCY.
If you smell propane, suspect a propane leak, observe a fire, or encounter another immediate unsafe condition, leave the affected area and contact 911 or the local fire department when emergency response is appropriate.

Do not rely on a text message to request or obtain emergency assistance.
SMS delivery depends on wireless carriers, communication networks, mobile devices, messaging providers, and other systems that may be outside Mountain Top Propane’s control.
Mountain Top Propane does not guarantee that a text message will be delivered, received immediately, remain available, or be error-free.
Text messages do not replace your responsibilities under your applicable propane service agreement, including responsibility for monitoring propane supply, requesting Will Call deliveries when applicable, maintaining safe access, and responding appropriately to leaks or unsafe conditions.
You are responsible for notifying Mountain Top Propane if you discontinue or change a mobile telephone number that you previously authorized for text messages.
If you receive Mountain Top Propane messages intended for another person or relating to an account with which you are not associated, please reply STOP or contact us so that we can update our records.
Mountain Top Propane uses mobile telephone numbers and SMS consent information for the purposes described in these SMS Terms and our Privacy Policy.
Mobile opt-in information and text-message consent will not be sold, rented, or shared with third parties or affiliates for their own marketing or promotional purposes.
Mountain Top Propane may provide information to service providers acting on our behalf when reasonably necessary to provide telecommunications, messaging, account-management, payment, technical, or related services.
